Who are we filing a lawsuit against?

Allergan is a pharmaceutical company known for being responsible for the manufacture of Botox. In 2019 it became part of Abbvie, one of the largest biopharmaceutical groups in the world.

Allergan lost the legal ability to market Biocell macrotextured implants in the European market in 2018 and recalled those same implants globally in July 2019, after the FDA requested a voluntary recall thereof.

The reason? Growing concern about the relationship between the use of these macrotextured breast implants and the development of ALCL, a cancer of the immune system.

The source of the damage

There is a direct relationship between Allergan Biocell brand macrotextured implants and BIA-ALCL.

The company was aware of serious defects in the design, manufacture and quality control of breast implants. The company initiated warranty programs that were limited to non-implanted prostheses, without providing an immediate solution to the wearers thereof and without covering replacement costs.

In the conditions in which they were produced, Allergan-branded macrotextured prostheses pose a risk to the health of women implanted with them and immediate action is needed so that this does not become an even bigger global public health problem.

Lawsuits are already underway against Allergan in the Netherlands and the United States. Merci represents more than 1,000 victims of the Allergan case and will begin actions in the coming months to make them part of existing and new proceedings.
